LPL commenced adjudication in relation to two payment applications. At enforcement of the resulting Adjudicator’s decision, Kershaw argued that the notice of adjudication referred to one application only. The notice stated in the redress “The referring party claims payment of the sum of £70,162.17 net excluding VAT for work carried out in accordance with that interim application No 8 and dated 16 June 200, if not what sum is to be paid?” The Judge concluded that the notice sought payment of all outstanding sums. As such, the Adjudicator had jurisdiction to make his decision and summary judgment was granted.
